These Terms & Conditions govern the use of the Skat-Trak website and the purchase and use of Skat-Trak products.

1. Acceptance of Terms

By accessing this website, purchasing products, or using any Skat-Trak product, you agree to be bound by these Terms & Conditions.

2. Orders & Pricing

All prices, specifications, availability, and product information are subject to change without notice. Skat-Trak reserves the right to refuse, limit, or cancel any order at its sole discretion.

3. Product Information

We make every effort to provide accurate product descriptions, specifications, and images. However, product specifications, appearance, and availability may change without notice.

4. Payment

Payment must be made according to the terms agreed upon at the time of purchase. Orders may be delayed or cancelled if payment is not received.

5. Shipping & Delivery

Delivery dates are estimates only and are not guaranteed. Skat-Trak shall not be responsible for delays caused by freight carriers, customs agencies, weather, supply chain disruptions, or other circumstances beyond our reasonable control.

Risk of loss and ownership transfer to the purchaser upon delivery to the carrier unless otherwise agreed in writing.

6. Returns & Warranty

Returns are subject to Skat-Trak's Return Policy.

Any warranty provided by Skat-Trak is limited to defects in materials and workmanship. Warranty coverage does not extend to damage caused by improper installation, misuse, abuse, overloading, underinflation, excessive speed, vehicle modifications, accidents, hazardous terrain, racing incidents, competition-related incidents, or other operating conditions beyond the control of Skat-Trak.

7. Assumption of Risk

Off-road driving, dune riding, motorsports, competition, and racing are inherently dangerous activities that may result in vehicle damage, property damage, serious injury, or death.

By purchasing, installing, or using any Skat-Trak product, the purchaser and user acknowledge and voluntarily assume all risks associated with such activities and the use of these products.

The purchaser and user are solely responsible for determining the suitability of any product for its intended application, ensuring proper installation, maintaining the vehicle in safe operating condition, and operating the vehicle in a safe and lawful manner.
 

8. Limitation of Liability

To the fullest extent permitted by law, Skat-Trak, its owners, officers, employees, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of use, business interruption, personal injury, death, property damage, or vehicle damage arising from the purchase, installation, use, misuse, or inability to use any Skat-Trak product.

The purchaser and user agree that the use of Skat-Trak products is at their own risk.
 

9. Intellectual Property

All website content, trademarks, logos, photographs, graphics, product names, and written materials are the property of Skat-Trak and may not be copied, reproduced, distributed, or used without prior written consent.
 

10. Website Use

Users may not use this website for any unlawful purpose, interfere with website operations, attempt unauthorized access, or transmit malicious software
or harmful code.
 

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
